Terms of service

Last updated 2026-05-07. By creating an account or using Songe you accept these terms.

1. Who you are contracting with

Songe is operated by Tanguy Delume, individual entrepreneur registered in France [PLACEHOLDER: SIREN, VAT number, registered address]. In these terms, "Songe," "we," "us," and "our" refer to that entity. "You" means the person creating an account or using the service.

2. What Songe is

Songe is a hosted, browser-based service that turns text prompts and reference images into 3D scenes. We orchestrate Anthropic's Claude language model and a headless Blender pipeline to render the scene; you can preview it in our viewer and download the resulting file. Generations consume credits from your account balance.

3. Eligibility

You must be at least 18 years old to use Songe. By registering, you represent that you meet this requirement. If you sign up on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

4. Your account

You are responsible for keeping your sign-in credentials secure. One person per account; do not share access. You must notify us promptly at tanguydelume@gmail.com if you suspect unauthorised access.

5. Credits, pricing and billing

Credit costs and tier benefits are listed on the credits page. We may change credit costs and tier benefits with at least 30 days' notice; previously-published rates are honoured for one full billing cycle after the change.

Payments are processed by Stripe under their own terms. Card data never reaches our servers.

Subscriptions auto-renew at the end of each billing period (tacit-renewal warning, French Code de la consommation Art. L215-1). You can cancel at any time from /profile; cancellation stops the next renewal but does not refund the period in progress. Twenty-five days before each annual renewal we will email you a reminder of your right to cancel (Art. L215-1).

Refunds: if a generation fails on our side (Blender crash, model error mid-run), the credits are refunded to your balance automatically. Successful generations whose output you don't like are not refundable — the compute time has already been spent.

6. Right of withdrawal — express waiver for digital content

Under French Code de la consommation Art. L221-18, consumers normally have a 14-day right of withdrawal for online services. Art. L221-28-13° allows that right to be waived for digital content delivered immediately after purchase, where the consumer consents in advance and acknowledges they will lose the right of withdrawal.

By starting a generation, topping up credits, or activating a subscription, you expressly request immediate performance of the service and acknowledge that you waive your 14-day right of withdrawal for the credits consumed or the subscription period started. Unspent credit top-ups remain refundable within 14 days.

7. Acceptable use

You may not use Songe to generate, upload, or distribute:

  • Sexual content involving minors, or any content sexualising children.
  • Sexual content depicting non-consensual acts on real, identifiable people.
  • Content depicting identifiable real people without their consent (deepfakes, harassment material). This includes specific protections under French Code civil Art. 9 (right to one's image).
  • Functional instructions or code for weapons capable of mass harm (chemical, biological, radiological, nuclear), or workable malware / cyber-weapons.
  • Direct, credible threats of violence against a real, named individual or group.
  • Content that infringes third-party intellectual property, trademarks, or trade secrets.
  • Doxxing material — physical addresses, phone numbers, or other private locators of real individuals.
  • Anything illegal under the laws of France, your country of residence, or the country where you use the service.

You may not (a) run automated traffic against the service beyond published rate limits, (b) scrape or mirror the service, (c) reverse-engineer the service to clone it or to extract sub-processor credentials, or (d) attempt to extract model weights or training data from generated outputs.

We may suspend or terminate accounts that violate these rules, remove offending content, and report illegal content to the relevant authorities (notably NCMEC and the French Pharos platform for CSAM).

8. Notice and action (illegal content)

If you believe content hosted on Songe is illegal under EU or French law, you can submit a notice under EU Digital Services Act Art. 16 by emailing tanguydelume@gmail.com with subject line DSA NOTICE. Please include:

  • The exact URL(s) of the content;
  • A substantiated explanation of why you believe the content is illegal;
  • Your name and contact email (anonymous notices accepted only for CSAM and similar offences);
  • A good-faith statement that the information in the notice is accurate.

We will acknowledge receipt and provide a statement of reasons (DSA Art. 17) for any action we take. If you are a Songe user whose content has been actioned, you may appeal by replying to that statement of reasons.

9. Content ownership and licence

You own your inputs. Prompts and reference images you upload remain yours.

You own your generated outputs, subject to applicable intellectual property law. Note: under French Code de la propriété intellectuelle, purely AI-generated works without sufficient human creative contribution may not qualify for copyright protection. We make no representation that your outputs are copyrightable.

What we ask in return: you grant Songe a limited, non-exclusive, worldwide, royalty-free licence to host, process, display, transmit, and store your prompts, reference images, and generated outputs strictly to operate the service (running the generation pipeline, showing the result back to you, storing it for the retention period in our Privacy Notice, taking backups). This licence terminates when you delete the content or your account, except as needed for billing records and safety logs (see Privacy Notice).

We do not use your content to train AI models. Anthropic processes your prompts under a zero-retention API policy.

Output non-uniqueness: generative AI may produce similar outputs from similar prompts across users. You have no exclusive right to a particular output against another Songe user who happens to generate something similar.

AI provenance labelling: exported scene files include machine-readable metadata identifying them as AI-generated where the format supports it (EU AI Act Art. 50(2)).

10. Your warranties

By submitting prompts or reference images, you represent and warrant that:

  • You have all rights necessary to upload the reference images;
  • Your prompts and uploads do not infringe any third party's intellectual property, privacy, or publicity rights;
  • Your prompts and uploads do not violate the Acceptable Use rules in §7;
  • You are solely responsible for how you use the generated outputs, including any commercial distribution.

11. Disclaimers — no warranty

Songe is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, or that outputs will meet your expectations.

AI outputs may be inaccurate, biased, or offensive. Generated content is not professional advice (legal, medical, financial, engineering, or otherwise) and must not be relied upon as such. You evaluate output suitability for your purposes.

12. Limitation of liability

To the maximum extent permitted by applicable law, Songe's total cumulative liability arising out of or related to these terms or the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) one hundred euros (€100). We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, or lost data.

Nothing in these terms excludes or limits our liability for: (i) death or personal injury caused by our negligence, (ii) gross negligence or wilful misconduct, (iii) fraud or fraudulent misrepresentation, or (iv) any other liability that cannot be excluded under applicable law (including French Code civil Art. 1170 and Code de la consommation Art. L212-1 protections for consumers).

13. Indemnification

You agree to indemnify, defend, and hold harmless Songe and its operator against any third-party claim arising from (a) your prompts, reference images, or generated outputs, (b) your breach of §7 Acceptable Use or §10 Warranties, or (c) your infringement of any third-party right. We will notify you promptly of any such claim and let you control the defence (subject to our right to participate at our cost).

14. Beta and experimental features

Some features may be marked "beta" or "experimental." They are provided without any warranty, may change or be removed at any time, and may operate with reduced reliability. Liability cap §12 applies, and the cap for beta features is specifically limited to the credits consumed by that feature.

15. Suspension and termination

You may delete your account at any time at /profile. Deletion is immediate and irreversible.

We may suspend or terminate your account for material breach of these terms, with reasonable prior notice except in cases of clear abuse, fraud, illegal content, or risk to the service or other users. On termination, you may export your generated content during a 14-day grace period; after that, content is purged subject to retention exceptions in the Privacy Notice.

Sections §7, §9, §10, §11, §12, §13, §17, §18, and §19 survive termination.

16. Force majeure

Neither party is liable for failure or delay caused by events beyond its reasonable control, including but not limited to outages or failures of sub-processors (Anthropic, Cloudflare, Stripe, Neon, Resend), acts of God, war, terrorism, civil unrest, labour disputes, government action, internet or power failures, or pandemic restrictions.

17. Mediation (consumers)

Pursuant to French Code de la consommation Art. L612-1, in the event of a dispute that has not been resolved by direct contact with us, you may refer the matter free of charge to:

18. Governing law and jurisdiction

These terms are governed by French law.

If you are a consumer domiciled in the European Union, you may bring proceedings against us in the courts of your domicile, and we may bring proceedings against you only in the courts of your domicile (Brussels I-bis Reg. 1215/2012, Art. 17–19). Mandatory consumer-protection law of your country of residence continues to apply.

If you are not a consumer, the competent courts of Paris, France have exclusive jurisdiction.

19. Miscellaneous

  • No arbitration for consumers: any pre-dispute arbitration clause is void as against a consumer under French Code civil Art. 2061. We do not require arbitration.
  • Severability: if any provision is held unenforceable, the rest remains in effect.
  • No waiver: failure to enforce any right is not a waiver of it.
  • Assignment: you may not assign these terms without our consent. We may assign them to a successor in connection with a sale of the business, with 30 days' notice.
  • Entire agreement: these terms together with the Privacy Notice and the Credits page constitute the entire agreement between you and Songe.

20. Changes to these terms

We may update these terms. Material changes affecting your rights are emailed to registered users at least 30 days before they take effect; you may terminate your account before they apply. Continued use after the effective date is acceptance.
